Consent to Personal Data Processing
Version of 31 October 2026
1. General provisions
1.1. This Consent to Personal Data Processing (the “Consent”) is given by the user when submitting the “Request a proposal” form on the website https://brightkind.ge (the “Website”) in accordance with the Law of Georgia “On Personal Data Protection” of 14 June 2023 (the “Law”).
1.2. The controller of personal data is Individual Entrepreneur Evgeniia Girinskaia, identification code 345871069, address: 23 Iusuf Paghava St, Batumi, Georgia, email: alina.filatova1982@gmail.com, phone: +995 571 07 92 19 (the “Controller”).
1.3. This Consent is a separate document and concerns personal data processing only. It does not replace a service contract.
1.4. By ticking the “I give my consent…” box and pressing “Send request”, the user confirms that they are at least 18 years old, that they have read this Consent and the Personal Data Processing Policy (https://brightkind.ge/en/privacy/), and that the data provided are accurate and belong to them. If the user provides data of another person, such as a colleague, the user confirms that they are entitled to do so and have informed that person that the data are being passed to the Controller.
1.5. Consent is given freely, for a specific purpose, after receiving information about the processing. Only an active action — ticking the box in the form — counts as consent. The form cannot be sent without it. The Website can be used without consent, and the Controller can be contacted without the form: by phone, email or messenger.
2. Purpose and legal grounds
2.1. The purpose of processing is to handle the user’s request: calculate the cleaning price, prepare and send a commercial proposal, contact the user to clarify details, arrange an on-site assessment and prepare to conclude a contract.
2.2. The legal grounds are the user’s consent and steps necessary to enter into a contract at the user’s request (Article 5 of the Law).
2.3. Data are not processed for other purposes, including advertising mailings, without the user’s separate consent (Article 12 of the Law).
3. Personal data processed
3.1. The data the user enters in the form are processed:
- name;
- phone number;
- email address, if provided;
- company name;
- type of premises, area and desired cleaning frequency;
- comment, if provided.
3.2. The page language and the date and time of submission are saved automatically together with them.
3.3. Please do not include in the comment any information not needed to calculate the cleaning, especially health data or other special categories of data.
3.4. Name, phone number and company name are required: without them the Controller cannot prepare a proposal. The other fields are optional.
4. Operations and disclosure
4.1. The user agrees to the following operations with their data: collection, recording, organisation, storage, updating, retrieval, use, disclosure to the processors listed in clause 4.2, blocking, erasure and destruction.
4.2. Processors:
- Netlify, Inc. (USA) — receiving and storing requests submitted through the form;
- Google LLC (USA) — the Controller’s email (Gmail), which receives a copy of the request and may be used to reply;
- WhatsApp or Telegram — if the user chooses this channel.
4.3. The user has been informed that Netlify and Google servers are located in the USA and other countries whose legislation may not ensure a level of personal data protection equivalent to that of Georgia, and of the possible risks, including access to the data by the authorities of those countries. By ticking the box, the user gives written (electronic) consent to such cross-border transfer (Article 37(2)(d) of the Law).
4.4. Data are disclosed to other persons only where expressly required by the legislation of Georgia.
5. Term of consent and retention
5.1. The Consent is valid until the purpose of processing is achieved, but for no more than 1 (one) year from the date the form is submitted.
5.2. If a contract is concluded as a result of the request, further processing is based on the contract and the Personal Data Processing Policy.
5.3. When the term expires or consent is withdrawn, the data are erased or destroyed within 10 (ten) working days, unless the law requires otherwise.
6. Withdrawal of consent
6.1. The user may withdraw this Consent at any time without giving reasons: by email to alina.filatova1982@gmail.com or by a message to +995 571 07 92 19 via WhatsApp or Telegram.
6.2. Withdrawal does not affect the lawfulness of processing carried out before it was received.
6.3. After withdrawal, the Controller stops processing and erases the data within the period set out in clause 5.3, unless it has another legal ground for processing.
7. Final provisions
7.1. The Controller may amend this Consent. The current version is published at https://brightkind.ge/en/consent/. If amendments affect the user’s rights, the new version does not apply to consents given earlier without the user’s renewed consent.
7.2. User rights, data protection measures and the procedure for requests are described in the Personal Data Processing Policy (https://brightkind.ge/en/privacy/).
7.3. This Consent is published in Georgian, English, Russian and Turkish. In case of discrepancy, the Georgian version prevails.
7.4. This Consent is governed by the legislation of Georgia.
